12.EXERTION OF WITHDRAWAL RIGHT former legislative decree 185/99
The buyer has the right to withdraw from the agreement within the expiry of 10 working days, beginning from the delivery of the goods.
In case the agreement regards services, the 10 working days begin from the stipulation date of the contract.
The withdrawal right is anyway excluded for the following agreements:
A) supply of services whose execution began, as agreed with the user, before the expiry of the dead-line of 7 working days
B) supply of goods or services whose price is bound to the floating of market rates which the supplier cannot control
C) supply of goods made to measure or clearly customized or goods which, for their own nature, can't be shipped back or risk to be damaged or go bad quickly
D) supply of audiovisual products or sealed computer software, open by the user
E) supply of newspapers, periodicals or magazines
F) supply of foods, beverages or other consumer products of home use supplied at the home, residence or place of work of the consumer from distributors who make frequent and regular rounds
G) agreements regarding supply of services related to accomodation, transport, refreshments, free time, when at the conclusion of the agreement the supplier commits himself to give these services in a precise date or period
Essential condition for the exertion of the withdrwal right is the substantial integrity of the goods to return.
The withdrawal right is exerted with the forwarding, within the expiry of 10 days from delivery, of a written communication through registered letter with acknoledgement of delivery to the jeweller's shop BOSCHI Sas, seated in Via del Cristo 3/b, 42025 Cavriago (RE) ITALY. The communication of withdrawal can also be sent , withing the same dead-line, by fax to the number 0522/575862 or by e-mail to the following address info@boschi-gioielli.it, provided that a confirmation by registered letter with acknolodgement of delivery follows withing the next 48 hours.
In case of withdrawal, the delivered product must be returned whole and in its original packaging to the jeweller's shop BOSCHI Sas, with seat in Via del Cristo 3/b 42025 Cavriago (RE) ITALY, within 10 working days from the date if was delivered.
The return of the product must take place at charge of the buyer, through insured package with carriage paid (packages with carriage forward or cash on delivery will not be accepted)
In case of exertion of the withdrawal right the vendor will reimburse to the buyer the paid amounts, within an expiry of not more than 30 days, beginning from the date of acknoledgement of the withdrawal, through bank transfer, on condition that the product was returned whole in its original packaging within the expiry of 10 days from delivery. The reimbursed amount will be equal to the price of the product, remaining at charge of the buyer the shipment cost.
